Bar Crusher Boats - Rockbank (Aust) Pty Ltd Warranty
The benefits of this warranty are in addition to any rights and remedies imposed by Australian State and Federal legislation that cannot be excluded. Nothing in this warranty is to be interpreted as excluding, restricting or modifying any State or Federal legislation applicable to the supply of goods and services which cannot be excluded, restricted or modified.
Rockbank (Aust) Pty Ltd trading as Bar Crusher Boats (“BCB”) provides a warranty for boats manufactured at BCB’s factory and is limited to repairing or replacing, at the BCB’s discretion, any part or whole products deemed by the company to be faulty in material or workmanship as follows:
BCB warrants with respect to each new boat manufactured by BCB and sold by BCB or a BCB authorised distributor that:
a. for a period of sixty (60) months from the date of original retail sale BCB will repair or replace any part of the hull structure that is considered by BCB to be defective; and
b. for a period of twenty-four (24) months from the date of original retail sale BCB will repair or replace any other part of the boat considered by BCB to be defective in factory materials or workmanship under normal use and operation within Australia.
For the purposes of this Warranty the following terms have the following meaning:
“The Dealer” is the authorised BCB dealer who made the original retail sale of the boat to the purchaser.
“The Purchaser” is the person or entity making the original retail purchase from BCB’s authorised Dealer.
This warranty applies providing that:
1. Provisions
1.1 This warranty will become effective upon receipt by BCB within one month of original retail sale, of the duly completed Bar Crusher Boats Warranty Copy.
1.2 This warranty applies when the boat:
• Has been properly used and operated. (See Owners manual)
• Has not been fitted with an engine (or engines) which exceeds the maximum horsepower or engine/ transom weights specified by BCB.
• Has been properly maintained and cared for. (See item 6 below and Owners manual)
• Has not been used for racing, competition or commercial use.
• Has not been modified or altered after having been dispatched by BCB from the factory.
• The boat has legible serial numbers.
2. The boat is used with a trailer which is correctly designed and adjusted and is considered by BCB not to have contributed to any defect.
3. The repair or replacement is carried out by an authorised BCB dealer, the BCB factory or by some other service provider approved by BCB and only after approval in writing has been given by BCB prior to the repair or replacement being carried out.
4. Unless prohibited by law, the liability of BCB under this warranty is limited to the repair or replacement of defective part or parts, or the cost of such repair or replacement approved by BCB prior to the repair or replacement being carried out. Provided that BCB complies with this warranty BCB has no liability under this warranty for any consequential or other loss caused by or arising out of, or relating
to the defective part or parts, whether or not caused or contributed to by the negligence or breach of contract of BCB or Rockbank (Aust) Pty Ltd or its agents.
5. The claim under this warranty must be made in writing, setting out full details of the problem encountered, addressed to: Bar Crusher Boats, 5 Quality Drive, Dandenong South, Victoria 3175 and sent within the period of:
• 60 months from the date of original retail sale if the claim is regarding a structural defect; or
• 24 months from the date of original retail sale for any other claim under this warranty.
6. All work agreed to by BCB will be done ex factory and freighting costs to and from the factory or BCB authorised repair facility are the responsibility of the purchaser.
7. The Purchaser must make the boat available to BCB and must bear the cost of transport of the boat to and from BCB’s factory or
authorised repair facility, and all insurance in the boat.
8. Required Maintenance
This warranty applies only where BCB products have been properly maintained to a high standard by the Purchaser and treated as follows:
• All boats must be thoroughly washed with fresh water and mild soap after use.
• No salt residue from salt water to be left on or in boat after use.
• Boat must be stored under cover or in shade to ensure UV sun damage is minimized.
• Batteries must be isolated by turning off battery isolation switch when boat is stored.
• All stainless fittings and moving parts on the boat to be lubricated and greased.
• Boat must be stored dry with all bungs removed.
• All wet carpets or mats must be removed from boat after use.
• Electrical wiring not to be earthed to hull. Always earth back to BUS bar or battery.
• All stone chips and nicks or scratches to paint work must be sealed (touched up) ASAP.
• Periodical maintenance and servicing is required at least every twelve months or 100 hours of use (which ever occurs first)
to ensure all moving parts are inspected, cleaned and lubricated.
9. If, in BCB’s opinion the boat has been abused, used improperly, neglected or used in an extremely rough manner or beyond its design
capacity then the warranty may, at the discretion of BCB, be void.
10. Paint is warranted against defective paint or application. Not against the normal effect of oxidation. Although BCB’s boats are built to a very high standard, no warranty is provided for minor paint disturbance around stainless fittings and fasteners over the life of the boat. All stainless fittings or fasteners fitted by the dealer or the purchaser must use isolative grease, gaskets or plastic washers to minimize potential paint disturbance.
11. Accessories, engines, trailers, electrical devices, parts and any other fittings fitted by the Dealer or the Purchaser and any effect they may have on the products supplied by BCB are the responsibility of the Dealer and Purchaser and are specifically not covered by this warranty.
12. This warranty specifically does not cover pumps (which if run dry or allowed to become clogged may burn out), light globes,
trailer bearings, tyres, batteries, fuses and normal wear and tear. All parts fitted by BCB to boats that have a separate manufacturer’s
written warranty are covered by that manufacturers warranty and not covered by this warranty.
13. Accidental damage to any part or parts of the boat and boat package are specifically not covered by this warranty. In addition,
windscreens are not warranted for scratching, chips, cracks, breakage or leakage.
14. Upholstery damage caused by UV (sun damage), cuts, abrasions or tears are not covered by this warranty.
Disclaimer
Weights and measures of all products offered by BCB are advisory only (i.e. they are approximate) and customers are advised to confirm all weights and measurements with their dealer if they are considered by the purchaser to be important. It also must be noted that dealers may package boats differently with varying fit out, trailer choice; engine choice and options choice and this will vary weights and measurements of the product.
